Consider Participation in Litigation Challenging Class Size Penalties
Issue/Rationale
The FSBA Board of Directors has approved entering into litigation to challenge the constitutionality of penalties for failure to make class size, which penalties were enacted by the legislature this year. The option is open for districts to participate in this litigation by adopting a resolution and executing a retainer agreement with the attorney's retained by the FSBA.

Recommendation against approval.
